Cashless catering biometric laws - New advice to schools will make clear that they will no longer be able to use pupils’ biometric data without parental consent. The advice, launched today for consultation, comes into effect from September 2013.
Schools Minister Nick Gibb said children’s biometric data was sensitive personal information and parents must have the right to prevent its use by schools and colleges. Pupils also have the right to refuse to participate and these provisions are explained in the guidance.
PROTECTION OF BIOMETRIC INFORMATION OF CHILDREN IN SCHOOLS
The new act means that parents must “Opt In” to biometrics and that one of a child’s parents must consent to their biometric information being taken. Previously a parent had to “Opt Out” of biometrics but this is no longer the case.
Please be aware that this is an Act and not guidelines therefore parents must “Opt In” before any biometric data is taken. Projects have updated the Parent Letter within our Implementation Pack and is currently making schools aware of this new Act.

Solihull Cashless Catering Award Notice
Solihull MBC have awarded their cashless catering contact to Nationwide Retail Systems Ltd. The trust-e cashless system will serve 67 Primary and Special School kitchens and will be made available to secondary schools / colleges, which may wish to adopt the system.
The online payment system may also be adopted by the Council should it offer value for money against existing provision.
